HMRC takes note of Intellect’s plea
The trade body will help train HMRC inspectors to better understand software R&D

Intellect, the trade association for the UK IT, telecommunications and electronics industries, has today commended the design of HM Revenue and Customs’ (HMRC) training course for its tax inspectors who specialise in R&D Tax Credit claims. The first training course is expected to run during the week commencing 02 October and Intellect, alongside HMRC, will be responsible for delivering the software aspect of the course.

The decision to provide training specifically on software was first proposed in the Treasury response document: Next steps for R&D tax credits in December 2005. This followed consultation on the R&D Tax Credit, responding to the representations from Intellect in particular.

Commenting, Tom Wills-Sandford, deputy director general at Intellect, said:
“In the past, the industry’s view has been that tax inspectors have not always understood the software development process and how it is related to R&D Tax Credits. It is gratifying that after several years of lobbying by Intellect, we are now presenting this course to give tax inspectors a better understanding of software R&D procedures.

We are delighted that HMRC has recognised Intellect’s concerns and we look forward to working with them. It is notable that half of this HMRC course on R&D will be on the software industry.”

Commenting on the benefits this training will provide to HMRC inspectors, Jeremy Sherwood, senior specialist on R&D, HMRC, said:
“We naturally want our inspectors to gain a fuller understanding of the R&D processes that take place within all types of industries, so they can help companies make better claims for R&D tax relief. Intellect has been telling us about particular issues with software claims and offered to help us train our inspectors. We are extremely grateful for their help.”

The course will be taking place over three days and will be split into two parts. The first half, which HMRC are responsible for, is devoted to R&D Tax Credits more generally. The second half of the course will focus purely on the software industry and will be delivered by Intellect, in conjunction with HMRC, and with major support from members of the accountancy profession, all of whom have worked in the software industry. Senior executives currently active in the software industry are also participating.
